The company you work for loses a contract and the new company to whom the contract is awarded terminates your employment with a redundancy package and notice (PILON) Does the notice period have to be added to the length of employment already served? If you were just about to enter another completed year of employment should this therefore enhance the redundancy package when it is based on number of completed years employment.
If you’re paid in lieu of notice, your employment ends immediately – at the start of what would have been your notice period, if you like, so you don’t accrue more length of service or eg holiday. Barring any reason why it’s a breach of contract for your employer to have paid you instead of letting you work your notice, it’s the notice that applies at the termination date, and also entitlement to statutory redundancy pay that applies at the termination date.
