Question

does my employer have to let me Tupe.?
my employer says they don’t want me to go to a new employer, who has bought part of the company in the area I cover.
I’m in this area more than 50% of the time.
can my employer refuse to let me move, especially if I agree with my employer?

Thanks for getting in touch. Your employer can’t refuse to let you move because TUPE operates automatically – if TUPE applies to you, then you transfer automatically. No one can agree to do something different because TUPE just overrides it. You can choose to reject the transfer but that means your employment automatically ends, which doesn’t sound like what you want.
