Guidance on gifting rules for estates over £325K and mentioning gifts in a Letter of Wishes or LPA2024-09-09T10:03:04+01:00

This is a really useful website so thanks for your excellent content. I have a question in relation to gifts.

Is it correct that it would only be deemed acceptable to gift the IHT allowance of £3K per annum and smaller gifts of £250 per person where the donor’s estate is OVER the £325K threshold?

If so, is it advisable to specify such gifting under “Preferences” or would it be acceptable to make reference to these gifts in a Letter of Wishes to be kept alongside the LPA? If the latter, would the COP need to approve as they would not be aware of a Letter of Wishes?

Many Thanks
