Hello, I’m co-executor for my late wife, she had a Will in which a Discretionary Trust was set up. I have obtained Probate myself. I need guidance as to what happens with this Trust and what action is required in respect of our jointly held property (held as trustees in common). The only other assets are some shares total value some £700. What are the likely costs for dealing with this? Thank you.

Hi, I’m sorry for not responding sooner but your email went to junk mail and I’ve only just found it. Marie’s will is some 10 pages plus there’s a Memorandum of Wishes, I cannot find anything to confirm what is being gifted to the Trust but her assets were very simple (bank a/c, PSBs, a Life policy and shares) and the idea was for her to leave everything to me (and similarly my will mirrors hers). Does this help or would you like to see a copy?

Hi, and thanks for your post.  So sorry to hear the loss of your wife.  Does your wife’s will gift everything to the discretionary trust, or a specific amount?
